AT THREE MINUTES PAST SEVEN, 31,000 FEET OVER SCOTLAND THE BOMB EXPLODED.

 

46 AND A HALF SECONDS LATER, 200,000 POUNDS OF KEROSENE IGNITED AS THE WINGS AND PART OF THE FUSELAGE CRASHED ONTO LOCKERBIE.

SO DECEMBER 7TH WAS THE ONLY DAY ON WHICH AL-MEGRAHI COULD HAVE BOUGHT CLOTHES FROM TONY GAUCI’S SHOP.

THE LOCKERBIE CRIME SCENE WAS HUGE. DEBRIS FROM THE CRASH FELL OVER A VAST AREA, ACROSS SCOTLAND AND INTO NORTHERN ENGLAND.

As the plane disintegrated, it fell, a lot of it, the material that was inside the plane, the personal possessions of those on board, fell in two broad strips that went away from the east from Lockerbie. One to the north, one to the south.

So the police searches were concentrated in these areas, and that’s where they found most of the important debris and the debris in particular that linked back to Malta and to Tony Gauci’s shop.

Just over there about a mile over there, just to the right of the summit, is a low area called Sufficient Hill. On Sufficient Hill on Christmas Eve, nineteen eighty-eight, the police found a bomb damaged umbrella. Now that umbrella was linked back to Malta and to Gauci’s shop. It was of a type that was sold in Gauci’s shop. Now this is absolutely critical because Gauci said, one of the very few consistent elements of Gauci’s account, was that as the customer who bought the clothes left the shop it started to rain, and the customer bought an umbrella.

The commission has raised some concerns as to whether or not it was actually raining on the day of the purchase of clothing from Tony Gauci's shop. Gauci claims it was and that is why he sold him an umbrella.

We are going to speak to this man. He was the man in charge and he may be able to tell us whether it was raining or not.

How certain can you be about rainfall on Malta say between 5PM and 7 PM on the night of 7 December 1988?

Major:

Between 5 PM and 7 PM well the records that I have here on the seventh December no rain fell at Luqa.

George: And how far away from Luqa is Sliema?

Major: About roughly about 5 km --as the crow flies.

George: And if you asked now to sum up about the rainfall on the 7th Dec 1988 what could you say?

Major: At that particular time in the evening on the seventh I am 100% certain that of the records that I have. Sliema being only about for 5 km away from Luqa I would actually again say that the percentage would be of no rain very high, say about 90%. Even as regards the cloud pattern at that time. I mean clouds, there was a lot of cirrus high clouds which normally it doesn't rain from that cloud

So the probability, let's say that. At that particular time of rain at Sliema is very low, let’s say that.

If I were to tell you that the Crown case the prosecution case that they were purchased if on 7 December you could say that by that time you had already performed the ceremony?

Yes the lights were turned on six December. I have no doubt in my mind.

This is my diary. It’s Tuesday, December 6. And down here, in pencil, 5:30, Christmas lights, ferries.

They said that the failure to disclose those documents also potentially created a miscarriage of justice. Unfortunately, they were not allowed to reveal the contents of those documents.

The other very important area of undisclosed information was information that the Scottish Criminal Case Revue Commission had discovered, from government files, which were considered to be secret, and they referred the case back, on the ground in part that this information was such, they’d seen it, was such that in itself, may have caused a miscarriage of justice. If Tony Gauci’s evidence about Abdel Baset al Megrahi is now wholly

discredited and - as this programme has shown - the forensic evidence that

linked a fragment of timer to Libya is also false, then the entire case

against the man found guilty of the bombing of Pan Am 103 collapses

completely. Had his appeal ever taken place then all this evidence would have

come to light and Megrahi would have walked from court as an innocent man.

Which begs a question. If Megrahi and Libya were not responsible for the

Lockerbie bombing, then who was?
