STÉPHANE DUJARRIC, UN SPOKESPERSON It took
three days for the Turkish authorities to reopen the border crossing because,
as you well know, this earthquake hit not only, of course, millions of
people, but it impacted the humanitarian operation itself, the humanitarian
infrastructure that was in place. لقد

MAZEN ALOUSH Bab al-Hawa Administration Not at all, not even 1% of damage happened on the crossing or to
any employee within the crossing, thanks to almighty God. The
road from the city of Hatay to the city of Al-Reyhanli was damaged, but the road from the city of Al-Reyhanli, where the United Nations warehouses are
located, towards the crossing, had no damage. |
|
43 |
RAED AL SALEH: The crossings were open, Turkey announced the next day that not
only the Bab al-Hawa crossing, but all the crossings are open. Qatar came and brought aid, and Saudi Arabia brought aid from the
Bab al-Hawa crossing, the Bab al-Salamah crossing,
and the Hammam crossing, but the United Nations did not. |
|
44 |
Nawal
Al-Maghafi: So one
thing you said earlier was that Turkey took three days to open up the border.
Can you just elaborate on that?
Stéphane
Dujarric: Well, I mean, let's give...let's understand the
situation. Southern Turkey was hit by a devastating
earthquake, right? Tens of thousands of people died. Roads were blocked. I mean, it's not a matter of blame. It's a matter
of fact. It took
time to clear the roads. It took time for humanitarian workers, whether
Turkish workers, international workers or others who were there to actually bring themselves back to a working state when
they had to deal with their own families, they had to deal with their own
houses having been collapsed.

VO Four days after the earthquake, the
death toll is still rising and is now 17,000 in total. At Bab al-Hawa, a convoy of six UN
trucks finally crosses the border. But the blankets and supplies are a
regular shipment that’s been delayed - not the earthquake aid that’s so
urgently needed.

regret to say that this assistance would have saved many lives. Until this moment, the aid related to search and rescue equipment

related to the civilians affected by this earthquake, also no aid has reached
them. The aid
that entered from the United Nations is routine aid. |

HEALTH SECRETARY: We have now passed the first stage of the disaster,
but we are on the verge of another disaster in the health sector, because all
the supplies in the warehouses have been used up, even what is available in
the private sector, private hospitals and the medical
market in northwestern Syria. If supplies are not entered through humanitarian
aid and the United Nations, we are heading towards a medical disaster in the
region. |

We made
a lot of appeals to them to provide the civil rescue team with machinery and
heavy equipment such as excavators and cranes, but no one responded. Currently, they say that equipment has entered, but in fact
nothing has entered. We are
not a hungry people who want foodstuffs, we just want supplies that help us
survive because we are people of dignity. We just wanted to save and help
those people who are suffering under the rubble. |

down to a narrow interpretation of international law.

Andrew Gilmour: I was the political director at the time and I
called colleagues from a number of departments, and
that is the point: How
could you possibly say international law is more important? There can be no doubt that the provision of strictly humanitarian
aid across borders cannot be regarded as unlawful intervention or contrary to
international law. Indeed it is the refusal to
permit cross border aid that is unlawful Perhaps no surprise given that one of those governments objecting
to UN cross border aid is Russia puse I mean if the law is saying you can't provide milk powder to a
starving baby because it's across an international border, then bugger the

Andrew Gilmour: The
UN's failure in north and northwest Syria is fundamentally not the fault of
the humanitarians For me,
the problem is rather those lawyers sitting in New York comfortably, but who
persist with such a narrow overly legalistic, cautious, and indeed callous
approach to law. فشل

VO: Marco Sassoli

aid to be provided across borders legally, even if the Syrian Government
objects. This is because of the Geneva Conventions, the treaties that protect

MARCO
SASSOLI: Well er we
simply say that um for this aid to civilian populations in need in rebel
controlled area, er neither the consent of Syria, nor a UN Security Council
resolution, which could, and which has in the past replaced the consent of
Syria, is necessary because in the article three, common to the Geneva
Conventions, to which Syria is a party, er we have a provision er stating
that an impartially humanitarian body such as the international committee of
the Red Cross may offer its services to the parties er to the conflict.

taken a different view. Can you explain that?
MARCO
SASSOLI: Yes, well obviously, if you are a UN lawyer, you are working for
an inter-governmental organisation, and it is logical that the UN only works
in a country with the consent of that member state. But I think here we have
a special situation.

Nawal Al-Maghafi:
So, you
know, eminent lawyers, professors, retired judges of the international court
of justice and former UN legal officials, they've all agreed that under
international law, the UN doesn't need the consent of the Syrian government
or even a security council resolution to deliver cross-border aid … لقد

Dujarric: Look, for us, it is clear. It's been our longstanding position
from the secretary, from the secretariat, that in order to
deliver humanitarian aid across an international border, we need either the
consent of the government or in the case that we have in Syria, a binding
security council resolution.

Nawal Are you
saying that what they're essentially saying is wrong?
Stéphane
Dujarric: What I'm saying to you is that we can have academic discussions
for weeks, months, and years about international law. There are thousands and
thousands of international law experts. I'm sure many are very eminent. Our
position is that international law has not delayed our work.

Nawal But in that instant, what was
delayed was earthquake-related aid equipment, no? And that's what they needed.
And that's what they didn't get based on the UN stance and their
interpretation of the law.
